The legislature in House Bill 09-1196 has directed this Board to commit $200,000 from the Nursing Home Penalty Cash Fund before 30 June 2010 toward measures that will improve the quality of life for residents in Colorado nursing facilities.

HB1196 – A bill for culture change

HB1196 Passed

We have great news that HB 1196 has passed through the legislature and is on its way to the Governor for signature.

The bill provides for money in the nursing home penalty cash fund to improve the quality of life for residents of nursing homes. The money can be used for consumer education to promote resident centered care in nursing facilities, and train state surveyors and ombudsman regarding resident directed care. It establishes an accountability board to provide recommendations on expenditures of the funds. The money allocated in 2009-2010 is $200,000 and for fiscal year 2010 and thereafter an amount equal to the lesser of the amount approved by the accountability board or twenty five percent of the money’s deposited into the nursing home penalty cash fund the immediate preceding year.

About the Bill

Colorado Culture Change Coalition is excited about HB1196 (PDF) that was just introduced in early February. Federal Civil Monetary Penalties (CMPs) and State CMPs/fines are imposed by the regulatory agencies that license nursing homes if a nursing home does not comply with regulatory standards.

Right now the money is used to help relocate residents in nursing homes when the nursing home shuts down. HB1196 is asking that a portion of that money be reallocated to a nursing home improvement and innovation fund so that it can be used to improve current nursing homes. HB1196 does not require any additional funding and does not use general fund money, so it is a smart, innovative move in these difficult financial times. There is also a safety net written into the bill so there is always adequate funding in case a nursing home closes and residents need to be moved.
